| Summary: | This article aims to address the issue of constitutional justice models and discuss the (in) existence (and the need for implementation) of a real Constitutional Court on Brazilian soil. The work is divided into two parts; in the first one it presents the models of constitutional justice - the US Supreme Court and the European Constitutional Courts - and, in the second, it presents the Brazilian model. Finally, it concludes that the absence of certain features - such as the organic and institutional separation of the Constitutional Court from the structure of the Judiciary, exclusive and concentrated jurisdiction for constitutional litigation, as well as differences in the manner of filling positions and permanence in the Court by mandate with determined term - prove the distance that exists between the Federal Supreme Court and the European Constitutional Courts. |
