Sumario:This article aims to perform a brief analysis of gender stereotyping, based on the understanding of the Inter-American Court of Human Rights (IACHR) in its decision handed down on September 7, 2021, in the case "Barbosa de Souza et al. Through a literature review, it will establish the initial concepts about stereotyping and gender, to subsequently establish how the relationship and the influence of gender stereotyping occurs in the Judicial Courts, especially in the Brazilian Criminal Court. Finally, through the analysis of the above mentioned sentence, it will be necessary to understand how the IACHR positions itself on the subject. Thus, this article intends to discuss judicial impartiality, exposing that the agents of the law, both in the investigative process and in the criminal procedure, are influenced by patriarchal values, thus generating the perpetuation of violence against women.
