| Sumario: | From the conception of the Democratic State and its unfolding, especially inferring the supremacy conferred to the Constitution and fundamental rights, the objective of this work is to address the issue of judicial review. To this end, reference will be made to the deferential position used by some contemporary authors and also to the active stance defended by others. The method of approach will be deductive. As an answer, through bibliographic research, it is intended to show the perfect compatibility of the judicial review with the democratic principle and understand it as relevant to the supremacy of constitutional values. |
